These terms govern your use of the NANDAS Fresh Mart mobile application.

Please read these Terms & Conditions ("Terms", "Terms and Conditions") carefully before using the NANDAS Fresh Mart mobile application (the "App") operated by [Your Company Name/NANDAS Fresh Mart Legal Entity Name] ("us", "we", or "our").

Your access to and use of the App is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the App.

1. Accounts

1.1. Account Creation:

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password, whether your password is with our App or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

1.4. Username:

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

2. Orders and Deliveries

2.1. Placing Orders:

By placing an order through the App, you are making an offer to purchase products subject to these Terms. All orders are subject to availability and confirmation by us.

2.2. Order Confirmation:

Once you place an order, you will receive an in-app notification and/or email/SMS confirming your order details. This confirmation does not signify our acceptance of your order; it is a confirmation that we have received it. A contract between you and NANDAS Fresh Mart for the purchase of the products will only be formed when we dispatch the products to you.

2.3. Pricing and Payment:

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Payment must be made in full at the time of placing the order, unless Cash on Delivery (COD) option is selected. We accept various payment methods as indicated on the App (e.g., credit/debit cards, UPI, net banking, COD).

You may cancel an order before it has been processed/dispatched. Once an order is out for delivery, it generally cannot be cancelled. Refer to our refund policy for details.

2.6. Cancellation by NANDAS Fresh Mart:

We reserve the right to cancel any order at our sole discretion, including but not limited to, cases of product unavailability, pricing errors, fraudulent orders, or inability to deliver to your location. If we cancel an order, we will notify you and process a refund if applicable.

3. Returns and Refunds

3.1. We strive to provide fresh and high-quality products. If you receive a product that is damaged, expired, or not as described, please contact our customer support within [e.g., 24 hours] of delivery with supporting evidence (e.g., photos).

3.2. Refunds or replacements will be issued at our discretion, subject to verification of the issue.

3.3. Certain products may not be eligible for return due to their perishable nature or hygiene reasons.

5.1. The App is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of NANDAS Fresh Mart.

6. Disclaimers

6.1. Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

6.2. NANDAS Fresh Mart does not warrant that a) the App will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the App is free of viruses or other harmful components; or d) the results of using the App will meet your requirements.

6.3. We do not guarantee the quality, accuracy, reliability, timeliness, or completeness of any information or content on the App, including product descriptions.

7. Limitation of Liability

7.1. In no event shall NANDAS Fresh Mart, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Indemnification

8.1. You agree to defend, indemnify and hold harmless NANDAS Fresh Mart and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms, or c) your violation of any rights of another.

9. Governing Law

9.1. These Terms shall be governed and construed in accordance with the laws of India, specifically the State of Andhra Pradesh, without regard to its conflict of law provisions.

9.2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our App and supersede and replace any prior agreements we might have had between us regarding the App.

10. Dispute Resolution

10.1. Any dispute or claim arising out of or in connection with these Terms or your use of the App, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Kavali, Andhra Pradesh, India, in accordance with the provisions of the Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof. The language of the arbitration shall be English. The decision of the arbitrator(s) shall be final and binding on both parties.

11. Changes to Terms

11.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11.2. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
